What Is FIRPTA?
FIRPTA stands for the Foreign Investment in Real Property Tax Act. Back in the 1980’s, the US government instituted a withholding tax at the time of sale when the property is owned by a foreign person. The tax code requires buyer’s to withhold up to 15% of the gross sales price if the seller is a nonresident alien, foreign corporation, foreign partnership, foreign trust, or foreign estate. These foreign sellers typically have two options when deciding how to approach the withholding. Meet Our Founder

When I first learned about FIRPTA, I was instantly intrigued. I spent the first few years pouring over the IRS’s revenue procedures. I read (and reread) the relevant publications and memorized the instructions for every FIRPTA related tax form that we use. I realized early in my career that it was really hard to get consistent information about FIRPTA. I made it my life’s mission to focus on educating my community and have spent the last 5 years traveling the nation in order to share my knowledge and experience with the people on the frontlines. If we are going to make a difference, we have to start “doing FIRPTA” differently than we have in the past. We have to start talking about FIRPTA at the start of every transaction instead of the end. There is still much work to be done but I know we can do it if we stick together.
